Digital Code in Benin: government adopts 8 implementation decrees
The Benin government has taken a new step in the effective implementation of the Digital Code with the adoption of eight implementing decrees.

SUMMARY
These texts complement the existing regulatory framework and aim to further stimulate the initiatives of digital sector actors.
Adopted in the Council of Ministers, these decrees cover strategic aspects ranging from electronic waste management to communication security, including the interoperability of digital services.
Texts to strengthen regulation and innovation
Among the decrees adopted, we find:
- – The decree setting the conditions for the exercise of electronic archiving service providers ;
- – The one defining the technical specifications, standards and minimum procedures related to the guarantee levels of electronic identification schemes, as well as their interoperability framework ;
- – A text governing the management and treatment of electronic waste on the national territory ;
- – A decree specifying the obligations of alternative infrastructure operators (energy, transport, water), in a logic of synergy and pooling.
Strengthened governance in a strategic sector
The adopted texts also address the sensitive aspects of digital security and economic regulation:
- – The competition rules applicable in the electronic communications sector, to guarantee an open and fair market ;
- – The management of radio frequencies used by state installations ;
- – The procedures for declaration, authorization and approval of cryptography means and services, as well as the mechanisms for resolving transactional disputes ;
- – Finally, the rules of interception and access to data, which define the authorized authorities, the execution procedures and the specific provisions in terms of cryptography.
Towards maturity of the digital framework
With this new series of texts, the Benin government affirms its willingness to equip the country with a secure, structured and development-driving digital ecosystem.
The Digital Code, adopted in 2017, is thus enriched with concrete application mechanisms, intended to guarantee the trust of users and the conformity of practices to international standards.
These decrees should accelerate the dynamics of the digital transformation already underway, while laying the foundations for an inclusive and sustainable digital environment.
