Connected Meters: ARMP Orders Reinstatement of General Invasion

The Public Procurement Regulatory Authority (ARMP) has instructed the National Agricultural Mechanization Company (SoNaMA) to resume the evaluation of a tender launched on June 15, 2026, for the acquisition of electrical and electronic components intended for the production of connected meters, by reinstating the bid from General Invasion SARL.

In its decision No. 2026-084 dated August 11, 2026, published on September 17, the Dispute Resolution Commission deemed the company’s appeal against the rejection of its bid admissible and well-founded.

The procedure was authorized on June 10. The tender notice was published on June 15 and 16, and was supplemented by an addendum released on June 25 and 29. Ten bids were received by the deadline of July 9 at 10:00 am.

General Invasion contested its disqualification through an initial administrative appeal on July 29. SoNaMA upheld the rejection on July 30, before the matter was referred to the ARMP on July 31.

The dispute centered on the bid guarantee declaration. General Invasion had listed the tender file number, “09/MAEP/DG-SoNaMA/PRMP/SP-PRMP of 15/06/2026”, instead of the required SIGMAP reference “F_SoNaMA_116236” as specified in the documentation.

According to the Commission, this discrepancy did not create any ambiguity regarding the relevant procedure. The number provided referred to the same tender for the acquisition of electrical and electronic components intended for SoNaMA’s connected meters. Therefore, the ARMP concluded that the bid was wrongly rejected for non-compliance of the guarantee.

The decision orders the person responsible for public procurement and the bid opening and evaluation commission to resume the analysis by reinstating General Invasion. This reinstatement does not equate to the award of the contract: the bid must be re-evaluated in the ongoing procedure.
