Benin – Constitutional revision: the Court will examine several appeals against the procedure on Thursday

The revision of the Constitution of 15 November 2025 will be debated next Thursday before the Constitutional Court.

Several citizens have brought cases before the Constitutional Court to challenge various aspects of the process that led to the recent revision of the Constitution in Benin.

The appeals mainly concern the conduct of the parliamentary proceedings and the legitimacy of the vote that ratified the reform.

Some of the petitions target the conditions under which the plenary sessions of 14 and 15 November 2025 were held, marked by a power cut that reportedly disrupted the debates in the National Assembly. The petitioners argue that this incident affected the regularity of the deliberations.

Other appeals attack the very admissibility of the bill filed on 30 October 2025. According to one of the petitioners, the procedure allegedly did not comply with the constitutional requirements governing the initiative for such a revision.

Three opposition MPs also challenged the legislative procedure used, arguing that essential provisions, notably those set out in Articles 154 and 155 of the Constitution, were not observed during the vote of 15 November. They consider that these irregularities undermine the validity of the adopted text.

The constitutional reform introduces fifteen new articles and amends eighteen others. Among the major changes is the extension of the term of office for the President of the Republic and for deputies, now set at seven years.
